Terms of Use
These Terms are an agreement between you and us about using Avatalk. By using the App you accept them. If you don’t accept them, don’t use the App. Our Privacy Policy explains how we handle your data.
1. The service
Avatalk turns a photo and words — typed, or recorded in your own voice — into a short talking video made with AI. It also offers restyled looks for a photo, HD versions, captions, greeting cards, a video editor, a synthetic voice of your own, and links you can share. Features and limits (for example, a video’s maximum length) may change.
2. Who can use Avatalk
You must be at least 13 years old (or the minimum age for digital consent where you live). If you are under 18, you may use Avatalk only with the permission of a parent or guardian, who accepts these Terms for you.
The App creates an anonymous account on your phone. Your credits and videos are tied to it. If you delete the App or reset your phone, a new account is created and we cannot always restore the old one; the support code in Settings helps us try.
3. Your content, your face and your voice
You keep ownership of the photos, words and recordings you provide (“Your Content”). You give us a limited permission to process Your Content, through our service providers, only to provide the App to you, as described in the Privacy Policy.
You promise that:
- every photo you use is of you, or you have the permission of the person in it — and that you only use a photo of a child if you are their parent or guardian;
- any voice you record is your own, or you have permission to use it;
- a synthetic voice you create is made from your own voice only, using the permission phrase in the App, which you read yourself.
4. What you must not do
You must not use Avatalk to make or share content that:
- shows or speaks as a real person without their consent, or is meant to deceive (for example, a misleading “deepfake”, fraud or a scam);
- is sexual and involves a minor, or is sexually explicit;
- is unlawful, defamatory, harassing, hateful, or encourages violence or self-harm;
- infringes anyone’s intellectual-property, privacy or publicity rights.
You must not try to disrupt, reverse-engineer, overload or get unauthorised access to the App or the services behind it. We may refuse, remove or hide content, stop you making links, or suspend access if you break these rules.
5. Automated checks
To keep the service safe, some requests are checked automatically. For example, the image service may refuse to restyle a photo, and the words of a video are checked before a link is made. When a paid request is refused this way, its credits are returned.
6. Links you share
A link lets anyone who has it watch that video and see the “From” name on its card, for 30 days or until you stop sharing or delete the video. Anyone can report a link; a reported video is hidden at once and reviewed by us. A link says the video was made with AI. Videos shared by an account that has never bought credits carry an Avatalk end card.
7. Credits and payments
- Credits. One credit is one second of finished video. Paid add-ons, such as an HD version, a restyled look or a voice of your own, cost a stated number of credits. Credits are not money, cannot be transferred or exchanged for cash, and do not expire.
- Buying credits. Credit packs are one-time purchases, and there is a one-time trial pack for accounts that have never bought anything. Nothing renews and there is nothing to cancel. New accounts do not receive free credits.
- When credits are used. A video uses its credits when it has been made. A video that fails costs nothing. If a finished video is never delivered to your phone within 7 days, its credits are returned. Add-ons are paid when you start them and their credits are returned if they fail or are refused. Deleting your voice does not return its credits.
- Refunds. Purchases are made and refunded through Apple, under Apple’s terms. If Apple refunds a purchase, the credits it added are removed from your balance. Apart from the automatic returns above, and except where the law requires otherwise, credits are not refundable.
- Earlier subscriptions. We no longer sell subscriptions. One bought in an earlier version renews through your Apple ID until you cancel it, and each renewal adds credits. Deleting the App does not cancel it.
8. Using what you make
The App and everything in it (apart from Your Content) belong to us or our licensors. Provided you follow these Terms, you may use the videos you make for any lawful personal or commercial purpose. You are responsible for how you use them.
9. AI-made content
Videos, voices and images are made by automated AI systems. They may contain mistakes or artefacts, and may not look or sound exactly as you expect. Check what you make before you share it.
10. No warranties
To the extent the law allows, the App is provided “as is” and “as available”, without warranties of any kind. We don’t promise that it will always be available, free of errors, or that its output will meet your expectations.
11. Limit of liability
To the extent the law allows, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost data, revenue or profits. Our total liability for any claim is limited to the amount you paid us in the 12 months before it. Nothing in these Terms limits liability that cannot be limited by law, or takes away rights you have as a consumer where you live.
12. Ending
You can stop using the App at any time, and delete your data as described in the Privacy Policy. We may suspend or end your access if you break these Terms. Sections that by their nature should continue (such as ownership, disclaimers and liability) continue after that.
13. Changes
We may update these Terms. We will change the date at the top, and tell you in the App when a change is significant. Using the App after a change means you accept it.
14. Law and disputes
These Terms are governed by the laws of the country where Elden Studios Company is established, and its courts have jurisdiction, without depriving you of the protection of the mandatory laws of the country where you live or of the right to bring a claim there.
15. Apple
These Terms are between you and us, not Apple. Apple is not responsible for the App or its content, and has no obligation to provide maintenance or support for it. If the App fails to meet any applicable warranty, you may notify Apple, and Apple may refund the purchase price of the App, if any; Apple has no other warranty obligation. Apple is not responsible for any claims relating to the App, including product liability, legal or regulatory claims, consumer-protection claims, or claims that the App infringes someone else’s intellectual property. You must comply with any third-party terms that apply when using the App, and you confirm you are not in a country subject to a US government embargo and not on a US government list of restricted parties. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
