Terms of Use

By downloading or using Avatalk you agree to these Terms. If you do not agree, do not use the App.

1. The service

Avatalk turns a photo and a written script into a short talking-avatar video, using AI voice and video generation. Features, limits, and pricing may change over time.

2. Eligibility and account

You must be able to form a binding contract to use the App. The App uses an anonymous, device-scoped account; you are responsible for activity that occurs through your device.

3. Your content and consent to likeness

You keep ownership of the photos and scripts you provide (“Your Content”). You grant us a limited license to process Your Content solely to provide the service (generate your video), as described in our Privacy Policy.

You represent and warrant that you have the right to use every photo you upload and that you have obtained the consent of any identifiable person shown in it. You must not upload images of a person without their permission.

4. Acceptable use

You agree not to use Avatalk to create or share content that:

• impersonates or depicts a real person without their consent, or is intended to deceive (for example, misleading “deepfakes”);
• is unlawful, defamatory, harassing, hateful, sexually explicit, or promotes violence;
• infringes others’ intellectual property, privacy, or publicity rights;
• attempts to disrupt, reverse-engineer, or gain unauthorized access to the App or its providers.

We may suspend or remove access and content that violates these Terms.

5. Credits and payments

• Credits are units used to generate videos (1 credit = 1 second of finished video). Credits are consumable, are not money, cannot be transferred or redeemed for cash, and — except where required by law — are non-refundable.
• Free credits. New users receive a one-time grant of free credits to try the App.
• Credit packs are one-time purchases that add credits to your balance. There is no subscription and nothing to cancel. Credits do not expire, and no recurring charge is made.
• Existing subscriptions. Avatalk no longer sells subscriptions. If you hold an auto-renewable subscription purchased in an earlier version of the App, it continues to renew through your Apple ID until you cancel, and each renewal adds credits to your balance. You can manage or cancel it in your Apple ID settings; deleting the App does not cancel a subscription.
• All purchases are processed by Apple and are also subject to Apple’s terms. Refund requests for App Store purchases are handled by Apple.

6. Intellectual property

The App, and all software, text, and design in it (excluding Your Content), are owned by us or our licensors. Subject to these Terms, you may use videos you generate for your lawful personal or commercial purposes, provided you comply with Section 4.

7. AI-generated output

Avatar videos are produced by automated AI systems and may contain inaccuracies or artifacts. You are responsible for how you use the output and for ensuring it complies with applicable law.

8. Disclaimers

The App is provided “AS IS” and “AS AVAILABLE” without warranties of any kind, to the fullest extent permitted by law. We do not warrant that the App will be uninterrupted, error-free, or that generated output will meet your expectations.

9. Limitation of liability

To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of data, revenue, or profits, arising from your use of the App. Our total liability for any claim will not exceed the amount you paid us in the 12 months before the claim.

10. Termination

We may suspend or terminate your access if you violate these Terms. You may stop using the App at any time; sections that by their nature should survive (ownership, disclaimers, liability) will survive termination.

11. Changes

We may update these Terms from time to time. Continued use after changes take effect constitutes acceptance. Material changes will be reflected by updating the effective date above.

12. Governing law

These Terms are governed by the laws of the country in which the Provider is established, without regard to conflict-of-laws rules, and you agree to the exclusive jurisdiction of its courts for any dispute not otherwise subject to Apple’s terms.
